Terms of Service

These terms govern your purchase and use of Flowscale products, operated by Harbor Software LLC, a Wyoming limited liability company. By buying or installing a Flowscale product you agree to them. Fees are in USD.

What you are buying

Flowscale sells digital goods: files, folder structures, templates and skills that you install and run inside your own AI assistant account. You are buying a licence to use those files, not a software service we host and not a transfer of ownership.

Your licence

You get a perpetual, non-exclusive, non-transferable licence to use the files inside one agency or business that you own or work for. You may modify them freely for your own use.

You may not resell, sublicense, republish, or redistribute the files or any substantial part of them, whether modified or not. You may not use them to create a competing product for sale.

What you need to supply

Flowscale runs inside your own AI assistant subscription. That subscription, its cost, and its terms are yours, not ours. We do not provide AI compute, API keys, or model access, and we are not responsible for changes a model provider makes to its own product.

Delivery

Digital products are delivered immediately after payment as a download or repository access. No physical goods are shipped.

Updates and support

Every OS tier includes a 12-month update and support entitlement from the date of purchase. After 12 months your files keep working and remain yours; continued updates may require a renewal.

No guarantee of outcomes

We sell a working system and a method. We do not guarantee revenue, clients, rankings, or any commercial result, because those depend on your market, your execution, and third-party platforms outside our control. Nothing on this site is a promise of earnings.

Liability

To the maximum extent permitted by law, Harbor Software LLC's total liability arising from these terms is limited to the amount you paid for the product in question. We are not liable for indirect or consequential loss.

Disputes and arbitration

We would rather solve a problem than argue about it, so contact us first and give us 30 days to resolve it. If that fails, any dispute arising out of these terms is resolved by binding arbitration seated in Sheridan, Wyoming, and may be conducted remotely. Each party brings claims only in its individual capacity, not as part of a class action.

Time limit on claims

Any claim arising out of these terms must be brought within one year of the event giving rise to it. A claim not brought within that year is permanently barred, to the extent the law allows.

Legal costs

In any arbitration or proceeding between the parties arising out of these terms, the prevailing party may recover its reasonable attorneys' fees and costs. This applies to both parties equally.

Governing law and venue

These terms are governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict-of-law provisions. For any matter not subject to arbitration above, the exclusive venue is the state and federal courts located in Wyoming, and you consent to the personal jurisdiction of those courts.

Assignment

You may not assign these terms without our written consent, except to a successor to your business by merger, acquisition, or sale of substantially all of your assets, provided that successor is not a competitor of ours and agrees to these terms. We may assign to an affiliate or a successor to our business. Any other attempted assignment is void.

Force majeure

Neither party is liable for a failure or delay in performance caused by an event beyond its reasonable control, including acts of God, natural disaster, war, civil unrest, or the failure of a third-party platform or network we depend on.

Changes to these terms

We may update these terms. The version in force is the one published here on the date of your purchase, and we will not apply a later change retroactively to a purchase you already made.
